Terms of Service

Welcome to Lux Level Up LLC ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our services and website. By booking or using any of our services, you agree to be bound by these Terms.

1. Services Offered

Lux Level Up LLC provides two primary categories of services:

  • Recovery Companion Services: Non-medical companion and concierge services for individuals recovering from cosmetic surgical procedures
  • Transformation Services: Coaching, accountability, and strategic planning services for personal development

2. Booking and Payment

2.1 Payment Terms

All services require full payment prior to service commencement unless otherwise agreed in writing. We accept major credit cards (with 3% processing fee), ACH transfer, Zelle, and Venmo.

2.2 Performance-Based Pricing

Payment Structure: Select transformation programs include performance-based pricing with potential refunds upon verifiable goal completion. The upfront price represents maximum cost; clients who complete all milestones within the specified timeframe earn predetermined discounts applied as refunds.

Refund Conditions: Refunds are contingent upon verified completion of all program requirements and are issued within 14 days of program completion. Partial goal completion does not qualify for partial refunds. This structure serves as a mutual commitment device: your financial investment incentivizes your success, while our refund risk incentivizes our quality.

No Standard Refunds: All sales are final. Refunds are only available through the goal completion mechanism described above.

2.3 Cancellation Policy - Recovery Services

  • 50% deposit required at booking
  • Cancellation more than 30 days before service: Full refund minus $500 booking fee
  • Cancellation 15-30 days before service: 50% refund
  • Cancellation less than 14 days before service: No refund
  • Final 50% balance due 7 days before service begins

2.4 Cancellation Policy - Transformation Services

Transformation services require payment in full before the first session. No refunds are provided except through the performance-based refund mechanism described in Section 2.2.

3. Client Responsibilities

3.1 Recovery Services

  • Clients must be under the active care of a licensed physician
  • Clients must provide accurate medical information and surgical details
  • Clients must follow all post-operative instructions from their surgeon
  • Clients must disclose any medical complications immediately
  • Clients are responsible for all surgical fees, medical costs, and prescriptions

3.2 Transformation Services

  • Clients must actively participate in weekly check-ins
  • Clients must complete assigned milestones and provide verification
  • Clients must respond to accountability communications within 24 hours
  • Clients must consult appropriate licensed professionals before beginning new exercise, diet, or wellness programs

4. Limitations of Service

4.1 Non-Medical Services

We are NOT medical professionals. We do not provide medical care, medical advice, medical treatment, wound care, medication administration, or medical monitoring. All medical care is the sole responsibility of your licensed physician and medical team.

4.2 Non-Therapeutic Services

Transformation services are not therapy or counseling. We are not licensed therapists, psychologists, or mental health professionals. Clients experiencing mental health concerns should seek appropriate licensed professional care.

4.3 Non-Dietary Services

We are not registered dietitians. Any nutritional guidance is for educational purposes only. Consult a licensed nutritionist or dietitian before making dietary changes.

5. Liability and Indemnification

5.1 Assumption of Risk

Clients acknowledge and accept all risks associated with post-surgical recovery and personal transformation activities. The Company is not liable for any medical complications, injuries, or outcomes related to surgical procedures or personal development activities.

5.2 Limitation of Liability

To the maximum extent permitted by law, the Company's total liability for any claim arising from our services shall not exceed the amount paid by the client for those services.

5.3 Indemnification

Clients agree to indemnify and hold harmless Lux Level Up LLC, its officers, employees, and agents from any claims, damages, or expenses arising from their use of our services or breach of these Terms.

6. Confidentiality and Privacy

We maintain strict confidentiality regarding all client information. Personal health information, transformation goals, and all communications are kept private in accordance with our Privacy Policy. We will not share client information with third parties except as required by law or with explicit client consent.

7. Service Modifications

We reserve the right to modify or discontinue services at any time. In the event of service cancellation by the Company, clients will receive a full refund of any prepaid amounts for services not yet rendered.

8. Dispute Resolution

8.1 Governing Law

These Terms shall be governed by the laws of the State of Florida without regard to conflict of law principles.

8.2 Arbitration

Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

9. Emergency Situations

In the event of a medical emergency during recovery services, we will immediately contact emergency services (911) and notify your designated emergency contact and surgical team. Clients authorize us to take reasonable emergency action to protect their health and safety.

10. Capacity Limitations

We limit our concurrent client capacity to ensure quality service. We reserve the right to decline service requests when at capacity or when we determine that our services may not be appropriate for a potential client's needs.

11. Photography and Testimonials

We will not use client photographs, testimonials, or personal information for marketing purposes without explicit written consent. Clients may be asked to provide consent separately; such consent can be revoked at any time.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy and Disclaimers, constitute the entire agreement between the client and Lux Level Up LLC regarding our services.
